Terms and Conditions of Spectrum Tickets

All ticket sales are final. No refunds or exchanges, except as specifically provided below shall be provided.
A ticket to the 2019 Spectrum International Paso Fino Horse Show (the “Show”) is a revocable license that only grants entry into the Tropical Park Equestrian Center (the “Center”) in Miami, FL and a spectator seat of the Show. Admission may be refused or withdrawn or ticket holder ejected in the sole discretion of the Florida Paso Fino Horse Association (“FPFHA”) and/or Paso Horse TV, LLC (“Paso Horse TV”).
THE SOLE AND EXCLUSIVE REMEDY if admission is refused or withdrawn by the FPFHA and/or Paso Horse TV or if the Show is cancelled, is a refund of up to the face value of the Show ticket.  Further, the liability of FPFHA and/or Paso Horse TV for any breach of any term for any ticket purchased shall not exceed the face value of the ticket. IN NO EVENT SHALL THE FPFHA AND/OR PASO HORSE TV BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF FACE VALUE FOR THIS TICKET.
Ticket holder may be relocated to an alternative seat in the sole discretion of the FPFHA and/or Paso Horse TV, and no such relocation shall entitle ticket holder to a refund or any other remedy if ticket holder is relocated to a seat of comparable face value.
Ticket holder and his/her belongings may be searched prior to or upon entry into the Center and/or other security checkpoints, and prohibited items may be confiscated. Ticket holder must comply with the FPFHA’s, the Center’s and Paso Horse TV’s security policies, including any applicable bag policy. Ticket holder consents to such searches and waives any claims against the FPFHA, the Center and Paso Horse TV, their affiliates, and/or their agents arising from or relating to such searches. If ticket holder elects not to consent to these searches or comply with these security policies, ticket holder acknowledges that the FPFHA, the Center and/or Paso Horse TV have the right to deny ticket holder entry. No refund or other remedy will be provided if ticket holder is ejected or refused entry due to disorderly conduct or failure to comply with these ticket terms or any security policies prior to or following entry.
TICKET HOLDER ALSO ACKNOWLEDGES AND AGREES that by tendering a ticket and entering the Center, ticket holder, on behalf of him/herself and, to the extent permitted by law, any accompanying minor(s), agrees to the following additional terms, conditions and waivers:
Ticket holder assumes all risks incident to the Show or related events, including the risk of lost, stolen or damaged property or personal injury of any kind and hereby waives any and all claims or potential claims arising from such risks, damage or injuries.
Ticket holder may not transmit or aid in transmitting any photographs, images, videos, livestreams or other accounts or descriptions (whether text, data or visual) in any media of all or any part of the Show or related events (the “Works”). Transmission or other distribution by, to, or for any purpose, and any public performance or display, direct or indirect, are also strictly prohibited. Ticket holder agrees that by tendering the admission ticket upon entry to the Center, ticket holder shall be understood to have signed this document and granted Paso Horse TV, LLC an exclusive, worldwide, sub-licensable, royalty-free license to all copyrights associated with the Works, including, without limitation, the right to broadcast, e-mail, transmit, livestream and otherwise distribute any and all Works.
Ticket holder grants to the Paso Horse TV, LLC and its designees the irrevocable, perpetual, worldwide and royalty-free right to use his or her voice, image, picture, photo, performance, appearance, action, likenesses, whether alone or in conjunction with others (collectively “Images”), as well as the right to create derivative works of any and all Images, which includes adapting, editing and mixing, in any and all media now or hereafter existing in connection with all or any part of the Show or related events, for any purpose whatsoever, including, without limitation, promotion, publicity, advertising, and/or commercial purposes of the FPFHA, the Center, and/or Paso Horse TV, their respective sponsors, licensees, advertisers and/or broadcasters, without further permission or compensation and hereby waives any and all claims or potential claims relating to such use.
The FPFHA, the Center, and/or Paso Horse TV are not responsible for lost, stolen, destroyed, or counterfeit tickets. Lost, stolen, destroyed, or counterfeit tickets, or tickets sold in violation of any applicable law, may not be honored. Tickets may not be used for, nor may any ticket holder enter the Center for, advertising, promotion or any other commercial purposes (including contests, sweepstakes and giveaways) without Paso Horse TV’s express written consent.
All ticket sales are final, neither the FPFHA, the Center, nor Paso Horse TV shall provide a credit against future purchases, an exchange of tickets, accept a return or provide a refund for any tickets purchased, unless the Show is cancelled and not rescheduled.
Any disputes concerning this ticket and/or the Center and/or the Show shall be governed by Florida law and adjudicated exclusively in the courts sitting in Miami-Dade County.
